1. Acceptance of Terms
By engaging Holtz Tree Service (including Holtz Firewood and Tree Service LLC) for any tree care services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any portion of these terms, please do not use our services. We reserve the right to modify these terms at any time without prior notice. Your continued use of our services constitutes acceptance of any changes.
2. Services Description
Holtz Tree Service provides professional tree care services throughout Minnesota, including but not limited to:
- Tree removal and takedown
- Tree trimming and pruning
- Storm damage cleanup and emergency service
- Stump grinding and removal
- Firewood cutting and processing
- Tree health assessment and consultation
- Hazard tree evaluation
- Lot clearing and land development
- Commercial and residential property maintenance
All services are performed in accordance with industry best practices and applicable safety standards. The scope of any specific project will be determined through consultation and detailed estimates.

Written Quotes: Upon request, we provide detailed written quotes for proposed work. These quotes are valid for thirty (30) days from the date of issue unless otherwise specified.
Price Adjustments: Quoted prices are based on conditions as presented at the time of the estimate. Significant changes to property access, tree condition, debris disposal location, or scope of work may result in price adjustments. We will notify you of any adjustments before proceeding with work.
Additional Services: Any work performed beyond the agreed scope will be charged at our standard hourly rates or agreed-upon pricing. We will request authorization before proceeding with additional work.
4. Scheduling and Cancellation
Scheduling: Scheduling is confirmed upon receipt of a signed agreement or verbal confirmation. We make every effort to maintain our schedule, but weather conditions, equipment issues, or other circumstances may require rescheduling.
Cancellation by Customer: If you need to cancel your scheduled service, notify us as soon as possible. Cancellations made with at least seven (7) days' notice will incur no charge. Cancellations made with less than seven days' notice may be subject to a cancellation fee equivalent to fifty percent (50%) of the estimated service cost.
Rescheduling: We will work with you to reschedule services at a mutually convenient time with minimal impact to your project timeline.
5. Payment Terms
Payment Methods: We accept cash, checks, and major credit cards. Payment details will be provided in your estimate or invoice.
Payment Schedule: For most services, payment is due upon completion of work. For larger projects, a deposit of up to fifty percent (50%) may be required to secure scheduling, with the balance due upon completion. Payment terms for specific projects will be outlined in the signed agreement.
Late Payment: Invoices not paid within thirty (30) days of the invoice date may accrue interest at the rate of one and one-half percent (1.5%) per month or the maximum rate permitted by Minnesota law, whichever is less.
Collection Costs: If your account is referred for collection due to non-payment, you will be responsible for all reasonable collection costs, including attorney fees and court costs.
6. Property Access and Preparation
Customer Responsibility: The customer is responsible for:
- Ensuring clear access to the work area, including removal of parked vehicles, outdoor furniture, and other obstacles
- Marking the locations of underground utilities (gas, electric, water, septic, irrigation)
- Notifying us of any environmental hazards or special conditions on the property
- Providing safe parking for our equipment and vehicles
- Securing pets and children during service hours
- Protecting any landscape features you wish to preserve
Call Before Digging: We encourage all customers to call Minnesota One-Call (811) to have utilities marked before we begin work. This protects you, us, and essential underground services. Any utility damage resulting from the customer's failure to mark utilities is the responsibility of the customer.
Work Area Setup: We will set up the work area according to safety standards and will take reasonable precautions to protect your property. However, some property disturbance is inevitable during tree removal and major service projects.
7. Liability and Insurance
Licensing and Insurance: Holtz Tree Service is fully licensed and insured to operate in Minnesota. We maintain comprehensive general liability insurance and workers' compensation coverage.
Our Responsibility: We are responsible for damages caused directly by our negligence or willful misconduct. Our liability is limited to the amount paid for the services that caused the damage, not to exceed the total contract price.
Customer Property: While we exercise reasonable care, we are not responsible for damage to structures, utilities, landscaping, or other property not directly involved in the service being performed, unless such damage results from our gross negligence or willful misconduct.
Customer Insurance: We recommend that customers maintain their own homeowner's or commercial property insurance to cover any damage that may occur during service work.
8. Weather and Delays
Weather Conditions: Weather conditions may affect our ability to safely perform tree services. We may need to postpone or reschedule work due to:
- Heavy rain or snow
- High winds
- Extreme temperatures
- Frozen ground conditions
- Poor visibility
- Other unsafe weather conditions
When weather delays occur, we will contact you to reschedule at the earliest convenient date. No additional charge will be assessed for weather-related rescheduling.
Unforeseen Circumstances: Delays may also result from equipment issues, crew availability, or other circumstances beyond our control. We will keep you informed of any significant delays and work to minimize impact to your schedule.
9. Warranty on Services
Quality of Work: We warrant that all work performed will be executed in a professional and workmanlike manner consistent with industry standards. We stand behind the quality of our services.
Warranty Period: If defects in our work are discovered within thirty (30) days of service completion, contact us immediately. We will, at our option, either correct the defect at no charge or provide a partial refund. This warranty covers only deficiencies directly caused by our work.
Tree Health Warranty: We do not warrant the future health or survival of trees after pruning, removal of branches, or related services. Tree health depends on multiple factors including weather, soil conditions, pest activity, and ongoing care, many of which are beyond our control.
Disclaimer: This warranty is exclusive and in place of all other warranties, express or implied. We make no other warranties regarding the services performed.
10. Dispute Resolution
Governing Law: These Terms & Conditions and all services provided by Holtz Tree Service are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions.
Jurisdiction: You agree that any legal action or proceeding relating to these terms or services must be brought in the state or federal courts located in Morrison County, Minnesota. You consent to the personal jurisdiction and venue of these courts.
Resolution Process: Before pursuing legal action, we encourage you to contact us directly to resolve any disputes. Please call (612) 600-8513 or email info@holtztreeservice.com with details of your concern. We will make a good-faith effort to resolve the matter within fourteen (14) days.
11. Limitation of Liability
To the maximum extent permitted by Minnesota law:
- Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption, regardless of the cause
- We are not liable for damage to property not directly involved in the service being performed
Some states do not allow limitations on liability, so this limitation may not apply to you. If any provision of this limitation is found to be invalid, the remaining provisions will continue in effect.
12. Intellectual Property
All content on the Holtz Tree Service website, including text, images, logos, graphics, and videos, is the exclusive property of Holtz Tree Service or its content providers and is protected by U.S. and international copyright laws.
You may view and print content from our website for personal, non-commercial use only. Reproduction, modification, distribution, or transmission of any content without our prior written permission is prohibited.
13. Changes to Terms
We reserve the right to modify these Terms & Conditions at any time without prior notice. Changes become effective immediately upon posting to our website. Your continued use of our services following any changes constitutes your acceptance of the modified terms.
For any proposed contract work, the terms agreed upon in the signed estimate or service agreement supersede these general Terms & Conditions to the extent of any conflict.

15. Severability
If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it shall be severed. The remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms & Conditions, together with any signed estimate or service agreement, constitute the entire agreement between you and Holtz Tree Service regarding our services and supersede all prior and contemporaneous agreements, whether written or oral. No waiver of any provision shall be valid unless in writing and signed by both parties.
